Terms of Service

These Terms govern your use of Lumen Notes (the "Service"), operated by Lumen Notes ("we", "us"). By creating an account or using the Service you agree to these Terms, our Privacy Policy, and our Acceptable Use Policy.

1. Who may use Lumen

The Service is built for licensed mental-health clinicians (therapists, psychologists, counselors, social workers) and the administrative staff of their practices. You must be 18 or older and, if you sign clinical notes in Lumen, you must hold a valid professional license in your jurisdiction. You are responsible for everyone you invite to your practice workspace.

2. What Lumen is — and is not

• Lumen is documentation software. It drafts clinical notes from session audio or your shorthand. It is not a medical device, not a diagnostic tool, and not medical advice.
• The clinician is always the author of record. AI output is a draft. You are responsible for reviewing, editing, and signing every note, and for its clinical accuracy and completeness. Nothing files unsigned.
• The AI does not diagnose and does not assess risk on its own. Risk-language flags are prompts for your review, not clinical determinations.

3. Your professional responsibilities

• You must obtain and document any client consent required to record sessions in your jurisdiction, including two-party consent where applicable. Lumen's consent gate is a tool, not a substitute for your legal obligations.
• You are responsible for compliance with your licensing board's documentation standards and your records-retention obligations.
• If you are a covered entity under HIPAA, execute a BAA with us before bringing PHI into the Service. See the HIPAA Notice.

4. Accounts and security

Keep your credentials confidential and use the multi-factor authentication we offer. Notify us immediately at security@lumen.1labs.app if you suspect unauthorized access. You are responsible for activity under your account until you notify us.

5. Subscriptions, billing, and trials

• Plans and prices are described on the Pricing page. Purchases are processed by Polar, our merchant of record.
• The free trial lasts 30 days and includes 20 notes; no credit card is required to start. At trial end, continued use requires a paid plan.
• Subscriptions renew automatically until canceled. You can cancel anytime from the customer portal; see the Refunds & Cancellation policy.
• If a renewal payment fails, we provide a 3-day grace period before access is paused. Your data is not deleted because of a failed payment.

6. Your content

You (or your practice) own the notes, records, and other content you create in Lumen. You grant us only the rights needed to operate the Service — storing, processing, transcribing, and drafting on your instruction. We do not use your content to train models and we do not sell it. On termination you may export your records; see the Privacy Policy for retention timelines.

7. Availability and support

We aim for high availability but do not guarantee uninterrupted service. Planned maintenance is announced in advance where practical. Support is available at support@lumen.1labs.app.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. AI-GENERATED DRAFTS MAY CONTAIN ERRORS; THE SIGNING CLINICIAN IS SOLELY RESPONSIBLE FOR THE FINAL CONTENT OF EVERY NOTE.

9. Limitation of liability

To the maximum extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the amounts you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill. Nothing in these Terms limits liability that cannot be limited by law, or our obligations under an executed BAA.

10. Termination

You may close your account at any time. We may suspend or terminate accounts that violate these Terms or the Acceptable Use Policy, with notice where practicable. Sections that by their nature survive (your content rights, disclaimers, limitation of liability) survive termination.

11. Changes

We may update these Terms; material changes will be emailed to account holders at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
